PROCEDURES FOR ADOPTION OF MAURITIAN CITIZENS BY FOREIGN NATIONALS
LIST OF DOCUMENTS TO BE SUBMITTED ALONG WITH APPLICATION FORM


I. PROCEDURES FOR ADOPTION OF FOREIGNERS BY MAURITIAN CITIZENS

Applications for adoption are processed at the Prime Minister’s Office.

(i) On the basis of favourable Home Study Report, the agreement in principle is granted subject to the couple being childless and on production of the following documents :-

(a) a Medical Certificate from a Medical Practitioner certifying that fertility treatment undergone has been unsuccessful and the chances of conception are insignificant or nil;

(b) Birth and Marriage Certificates of couple;

(c) photocopies of ID cards of couple;

(d) letter from foreign orphanage/institution/authorities requesting for Home Study Report and agreement in principle; and

(e) any other relevant information in support of the request.

(ii) A copy of the Home Study Report is also handed over upon request.

(iii) Following identification and acceptance of the couple of a proposed child, legal procedures are completed in the foreign country to confer custody of the child to the adoptive parents.

(iv) The formal approval of the Prime Minister’s Office is sought after submitting the following documents :-

(a) the legal papers from overseas as evidence of a person having been identified for adoption; and

(b) a draft Adoption petition to be produced to the Judge in Chambers after consultation with their legal advisers,.

(v) A copy of the Rule of Adoption is submitted to this Office in due course for Citizenship purposes.

II. PROCEDURES FOR ADOPTION OF MAURITIAN CITIZENS BY FOREIGN NATIONALS


The National Adoption Council Act 1987 provides for the establishment of a National Adoption Council which operates under the aegis of the Prime Minister's Office.

The Objects of the Council are :-

(a) to inquire into all demands for the adoption of citizens by non-citizens before any application is made to the Judge in Chambers;

(b) to advise the Minister on all matters relating to demands specified in paragraph;

(c) to co-ordinate with overseas official agencies engaged in the adoption and welfare of children.

Application Procedures

(a) A non-citizen wishing to adopt a citizen, who is still a minor, has to submit an application on the prescribed form to the Council which shall authorise or otherwise, the application for adoption to be made to the Judge in Chambers after due consideration being given to the case.

(b) Any person who is aggrieved by such decision may appeal to the Judge in Chambers within 21 days of receipt of the notice of rejection.


List of Documents to be submitted along with Application Form :

(i) Birth Certificate and 4 passport-size photographs of child to be adopted.

(ii) Two comprehensive medical certificates of the child to be adopted. It should inter-alia give an indication of the child's general health, his suitability to live in the country of his adopting parents and whether he suffers from any allergies.

(iii) Birth Certificates of biological parents.

(iv) Marriage Certificate/Divorce decree of biological parents (if applicable).

(v) Comprehensive medical certificates on biological parents including tests for AIDS and venereal diseases.

(vi) 2 passport-size photographs of biological parents.

(vii) Birth Certificates of applicants.

(viii) Marriage Certificate of applicants.

(ix) A report on family background from an official agency accredited to the Government or Government Department of the Country adopting parents.

(x) A report on financial means supported by official documents.

(xi) Record of convictions, if any (extrait de casier judiciaire).

(xii) Certificate of character (certificat de bonne vie et de bonnes moeurs).

(xiii) Title deeds (titres de proprieté)

(xiv) A progress report on any adopted Mauritian child by an official agency accredited to the Government (if applicable).

(xv) In case of sterility, to produce medical certificate.

(xvi) A certificate from a reliable person to take charge of the child/children in case of accident or morality of the adopting parents (Certificat de Prise en Charge).

(xvii) Application fee : Rs 5 000
